1. Status of the project

This site exists so that people interested in the project can follow it and hear first when there is news. Nothing on it is an offer of accommodation, of services or of anything else, and nothing on it can be accepted so as to form a contract for a stay.

2. What the interest list is, and is not

The interest list is a way of telling us you would like to be kept informed. Joining it is free and takes nothing from you but an email address.

Being on the list is not:

• a reservation, a booking, an option or a right of first refusal;
• an offer from us, or a contract of any kind;
• a guarantee of a room, a room type, a date, a rate or availability;
• a queue position, a priority or a claim to be served before anyone else.

No payment, deposit or fee is taken at any point, and we will never ask you for card details in connection with the list. If you ever receive a message that appears to come from us and asks for payment or card details, it is not from us; please forward it to [email protected].

When reservations do open, we intend to write to the list before announcing it more widely. That is a statement of intention, not a promise of priority, and it confers no legal right.

3. How to read the information on this site

The project is in design, and design changes. Everything published here is indicative and may change without notice:

• Images are artist's impressions, not photographs. Nothing shown has been built. Layouts, materials, finishes, furniture, landscaping and views are illustrative.
• Areas, capacities and counts — room sizes, the number of rooms and suites, event capacities — are planned figures, subject to change as design and construction progress.
• Facilities described as planned may be altered, combined, postponed or dropped, whether for design, regulatory, commercial or construction reasons.
• The map is illustrative and not to scale. The exact location has not been announced.

We take care to keep this site accurate and to update it as the design settles, but we do not warrant that any particular detail will be reflected in the finished building.

4. The planned gaming lounge

The entertainment and gaming lounge shown on this site is subject to licensing. Gambling in Norway is tightly regulated and land-based casinos are not currently licensed. The gaming areas would open only if the necessary permission were granted.

We make no representation that a licence has been granted, applied for successfully, or will be granted, and no representation about when or on what terms any gaming facility might operate. The rest of the resort is designed so as not to depend on that permission.

5. The opening date

There is no opening date. When one is announced it will be a target, not a guarantee: construction projects move, and this one may move too. No date mentioned in any message, page or conversation should be relied on for booking travel, planning an event or making any other commitment.

6. Project news by email

If you consent, we will send occasional emails about the project: design updates, construction progress, the opening date once there is one, and word of when reservations open. We do not send daily messages, and we do not pass your address to anyone else for their marketing.

You can unsubscribe at any time by writing to [email protected] or by replying to any message we have sent you. How your data is handled is set out in the Privacy Policy.

7. Booking terms, when they come

Terms of reservation and stay — rates, deposits, cancellation, house rules, check-in and the rest — do not exist yet, because there is nothing to book. They will be written and published on this site before reservations open, and they will apply to bookings made after that point.

These present terms will not be stretched to cover reservations. Nothing here creates an obligation to offer a booking on any particular terms.

8. Age

The interest list is for adults: please do not join it if you are under 18. The planned gaming lounge, subject to licensing, would be open only to guests aged 18 and over, and identification would be required.

9. Intellectual property

The texts, images, visualisations, design and name published on this site belong to the site owner or are used with permission. Nothing here transfers any right in them to you. The full terms governing use of the site, including what you may and may not do with its content, are in the Terms of Service.

10. Limitation of liability

The information here is provided in good faith for the purpose of describing a project in development. To the fullest extent permitted by law, we are not liable for loss arising from reliance on indicative project information — for example travel booked, arrangements made or expenditure incurred in anticipation of an opening, a facility or a licence.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or under the mandatory consumer protection law described in section 13.

11. Force majeure

We are not responsible for delay or failure caused by events beyond our reasonable control, including war, civil unrest, natural disaster, epidemic, fire, flood, extreme weather, strike, failure of utilities or communications networks, cyber-attack, or any act, decision or refusal of a public authority — including a refusal or withdrawal of a licence.

12. Complaints

If something on this site is wrong, misleading or unclear, or if you are unhappy with how we have dealt with you, write to [email protected]. We acknowledge complaints within five working days and aim to give a substantive answer within thirty days, telling you what we have done or why we disagree.

13. Governing law and disputes

These terms are governed by the law of Ukraine, where the site owner is established.

If you are a consumer resident in the European Economic Area, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of that country. For consumers resident in Norway, Norwegian mandatory consumer protection law — including the Marketing Control Act — continues to apply.

Consumers in the EEA may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obliged to take part in proceedings before a consumer arbitration body, and we prefer to settle complaints directly.
